INDIA: Supreme Court allows private unaided schools managements in Rajasthan to collect 100% school fee from students in 6 monthly installments from March 5, 2021.
The Court also says schools can’t expel students or withhold their exam results on the ground of non-payment of fees.
A bench headed by Justice Khanwilkar also stays the Rajasthan High Court judgment which allowed managements to collect only 60% to 70% tuition fee.
Matter to be finally heard in coming days. Meanwhile, installment arrangement to continue. The Court clarified that the installment arrangement will be independent of the fees which would be payable by the students for the academic year 2021-2022.
The Court also directs the State of Rajasthan to clear the outstanding dues with respect to unit costs in private unaided schools, meant to cover the costs borne by pvt schools to teach 25% EWS students as per RTE Act, within one month from today.
